StackMe – Terms of Service

Welcome to StackMe (“we,” “our,” or “us”). By downloading, accessing, or using the StackMe mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use StackMe.

1. Eligibility
You must be at least 18 years old* (or the age of majority in your jurisdiction) to use StackMe.
You are solely responsible for complying with all local, state, and national laws that may apply to your use of StackMe.
StackMe is not intended for use in jurisdictions where real-money challenges are prohibited.
2. Overview of Service
StackMe allows users to challenge their friends to outcomes (“Stacks”) for real money.
To send or accept a Stack, you must:
Be friends with the other user on StackMe.
Have a valid credit/debit card on file (processed securely by Stripe).
Have a PayPal account to receive winnings.
Once a Stack is accepted, both users must confirm the outcome.
If either user reports a loss, the agreed amount (plus a StackMe fee) is charged to their card, and the winner receives payment via PayPal.
3. Fees
StackMe charges a 7% fee on each completed Stack.
You authorize Stripe to process payments and PayPal to deliver winnings.
StackMe does not directly store or handle your payment credentials.
4. User Responsibilities & Disputes
Outcome Decisions: StackMe does not arbitrate disputes. The outcome of a Stack is decided solely by the participants.
Fair Play: You agree to act in good faith when resolving Stacks.
Disputes: If you and your opponent cannot agree on the outcome, the Stack remains unresolved, and no funds are transferred.
5. User Content & Conduct
StackMe includes a social feed where users can see Stacks and post comments.
We do not actively monitor content, but we may remove or restrict content that violates laws, promotes violence, harassment, hate speech, or illegal activity.
You are solely responsible for any content you post.
6. Prohibited Uses
You agree not to:
Use StackMe for illegal gambling or betting activities.
Create fraudulent accounts, impersonate others, or misuse payment systems.
Engage in harassment, hate speech, or posting illegal content.
7. Disclaimer of Warranties
StackMe is provided “as is” without warranties of any kind.
We make no guarantees regarding uptime, reliability, or accuracy of outcomes or content.
8. Limitation of Liability
To the fullest extent permitted by law, StackMe and its affiliates, officers, employees, and partners are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, arising from your use of the App.
In no event will StackMe’s total liability to you exceed the greater of:
1. $100 USD, or
2. The total amount of fees you paid to StackMe in the 12 months prior to the claim.
9. Gambling Disclaimer
StackMe is not a gambling or betting platform.
All Stacks are private, peer-to-peer challenges between friends, based on outcomes decided solely by the users involved.
StackMe does not determine or influence the outcome of any Stack.
StackMe does not allow games of chance, lotteries, or wagering against the platform.
By using the App, you acknowledge and agree that you are engaging in friendly competitions, not gambling.
10. Account Suspension or Termination
We may suspend or terminate your account at any time if you violate these Terms or applicable law.
11. Arbitration & Dispute Resolution
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of StackMe will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Class Action Waiver: You agree that disputes will be resolved on an individual basis only and not as part of any class or representative action.
Exceptions: You may bring a claim in small claims court if it qualifies.
Opt-Out: You may opt out of arbitration within 30 days of creating your account by sending written notice to [email protected]
12. Governing Law
These Terms are governed by the laws of the United States of America, without regard to its conflict of laws principles.
13. Changes to Terms
We may update these Terms from time to time. Continued use of StackMe after changes constitutes acceptance.
